In Brief

We collect only the personal data needed to communicate with you, manage our relationships, and operate our website. We do not sell your data, we apply appropriate safeguards when it is transferred outside the EEA, and you can exercise your GDPR rights — including access, correction and erasure — at any time by contacting us.

1. Who We Are

ARD Capital Partners is a Dutch-Brazilian real estate investment firm. For the purposes of the GDPR, ARD Capital Management B.V., Chamber of Commerce (KvK) No. 99265540, registered office at Van Baerlestraat 3-2, 1071 AL Amsterdam, the Netherlands is the data controller responsible for your personal data. You can contact us at info@ardcapitalpartners.com.

2. What Personal Data We Collect

Depending on how you interact with us, we may collect:

  • Contact details you provide to us, such as your name, email address and phone number, when you fill in a contact form, request an investor brochure or fund fact sheet, register for an event (such as our São Paulo business trip), or subscribe to updates;
  • The content of any correspondence you send us directly;
  • Technical and usage data collected automatically when you visit our website, such as your IP address, browser type and device information, pages viewed and referral source, typically via cookies and analytics tools (see our Cookie Policy);
  • Information you provide if you apply to work with us or request to become a partner.

3. How We Use Your Data

We use your personal data to:

  • Respond to your enquiries and provide the materials you have requested (e.g. fund fact sheets, investor brochures);
  • Manage and administer our relationship with investors, partners and business contacts;
  • Send you updates, newsletters or event invitations you have opted in to receive;
  • Operate, maintain, secure and improve our website;
  • Comply with our legal, regulatory and contractual obligations.

We rely on your consent, the steps necessary to respond to your request prior to entering into a relationship with you, and our legitimate business interests as the legal bases for this processing.

Legal Basis
What This Means
Consent
Where you have given clear consent for us to process your data for a specific purpose, for example subscribing to our newsletter.
Pre-Contractual Steps
Where processing is necessary to take steps you request before entering into a business relationship with us.
Legitimate Interests
Where processing is necessary for our legitimate business interests, provided this does not override your own rights and interests.

4. Cookies

Our website uses cookies and similar technologies. For details on what cookies we use and how you can manage your preferences, please see our Cookie Policy.

5. Sharing Your Data

We do not sell your personal data. We may share it with:

  • Trusted service providers who process data on our behalf, such as Webflow (website hosting), HubSpot (forms and CRM) and Google (website analytics);
  • Our professional advisers, where necessary;
  • Regulators, authorities or other third parties where we are required to do so by law.

6. International Transfers

Some of the service providers referred to above may process personal data outside the European Economic Area (EEA), including in the United States. Where this occurs, we take steps to ensure appropriate safeguards are in place, such as the European Commission's Standard Contractual Clauses.

7. Data Retention

We retain personal data only for as long as necessary to fulfil the purposes described in this Privacy Policy, or as required by applicable law.

8. Your Rights

Under the GDPR, you have the right to:

  • Request access to the personal data we hold about you;
  • Request correction of inaccurate or incomplete data;
  • Request erasure of your data;
  • Request that we restrict or object to certain processing;
  • Request that we transfer your data to another party (data portability);
  • Withdraw your consent at any time, where processing is based on consent;
  • Lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) or your local supervisory authority.

To exercise any of these rights, please contact us at info@ardcapitalpartners.com.

If you believe our processing of your personal data infringes the GDPR, you also have the right to lodge a complaint with a supervisory authority, in particular in the EU member state of your habitual residence, place of work, or the place of the alleged infringement. In the Netherlands, this is the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

9. Security

We take appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, misuse or alteration.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page together with a revised "last updated" date.

11. Children's Privacy

Our website and services are not directed at children, and we do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us at info@ardcapitalpartners.com and we will take appropriate steps to remove that information.
